Welcome and thank you for your interest in Loan Compass (operated by Loan Compass LLC and its affiliates, collectively, “Loan Compass”). By clicking a registration or new account submission button, or by otherwise using Loan Compass’s websites, networks, mobile applications, or other services provided by Loan Compass (collectively, the “Services”), or accessing any content provided by Loan Compass through the Services, you agree to be bound by the following terms of use, as updated from time to time (“Terms of Use”).  To use some of the Services, you may need to provide information to third parties.  For more information, see our Privacy Policy.

These Terms of Use, together with Loan Compass’s Privacy Policy, set forth the terms and conditions (“Terms”) that apply to your access and use of the Services that are made available through our websites including but not limited to www.loancompass.com as well as through certain downloadable mobile applications (together, the “Site”).  Loan Compass includes its officers, directors, employees, consultants, affiliates, subsidiaries and agents.  These Terms state that any disputes between you and Loan Compass must be resolved in arbitration or small claims court.

1.  Loan Compass’s Role. LOAN COMPASS DOES NOT, AND THE SERVICES ARE NOT INTENDED TO, PROVIDE LEGAL, TAX, OR FINANCIAL ADVICE. LOAN COMPASS IS NOT A FINANCIAL OR REAL ESTATE BROKER OR LENDER. FOR ADDITIONAL INFORMATION. PLEASE SEE SECTION 9.  Loan Compass’s business is primarily funded through advertising. You understand and agree that the Services may include advertisements, and that these are necessary to support the Services. To help make the advertisements relevant and useful to you, Loan Compass may serve advertisements based on the information we collect through the Services. See the Privacy Policy for more details.

2.  Third Party and Linked Services. The Services include links to third-party products, services and Web sites, as well as materials provided by third parties, and may include functionality that allows for the distribution of your User Materials or your personal information (collectively, your “User Information”) to third parties not under Loan Compass’s control (each, a “Third-Party Provider”). Third-Party Providers are solely responsible for their services. You are responsible for your use and submission of User Information to any third-party, and your dealings or business conducted with any third party arising in connection with the Services are solely between you and such third party. Your use of third-party sites, services, or products may be subject to associated third-party terms of use and privacy policies or other agreements, which you are solely responsible for complying with. Loan Compass does not endorse, and takes no responsibility for such products, services, Web sites, and materials, or a Third-Party Provider’s use of your User Information. By using the Services, you agree that Loan Compass may collect, store, and transfer applicable User Information or other information to the applicable third-parties on your behalf, and at your sole request.  If you submit a contact form or otherwise indicate your interest in contacting a Third-Party Provider, you may receive telemarketing calls from the Third-Party Provider using the contact information you provided. Third-Party Providers may keep your contact information and any other information received by the Third-Party Provider in processing a contact or other request form. You acknowledge and agree that Loan Compass has not reviewed the content, advertising, products, services, or other materials that appear on such third-party websites or services, and is not responsible for the legality, accuracy, or appropriateness of any such content, and shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of any such third party websites or services.

a. Financial Products. If you choose to contact a bank, lender, financial institution, originator, loan broker, or other mortgage professional through the Services by filling out a contact, other request form or otherwise indicating your interest in contacting (or being contacted by) a Third-Party Provider (including requests for rate quotes) on the Services, you authorize Loan Compass to provide the information you submit to the Third-Party Provider. If you include your name, contact information and other information in a request, your identity will no longer be anonymous to the Third-Party Provider. Your submission of information and any request for quotes through the Services is not an application for credit. Loan Compass is only providing an administrative service to consumers and participating Lenders. Decisions regarding Lenders contacting consumers are made by participating Lenders and not Loan Compass. These non-binding quotes are not intended to be official Loan Estimates as defined in the Real Estate Settlement Procedures Act. By using these features, the disclosures and consent required under certain state laws are deemed to be provided, received, and agreed to. Interest rates displayed through the Services are for information purposes only and reflect non-binding customized quotes of the terms a Lender might offer a borrower fitting a consumer’s anonymous profile. Actual interest rates may vary. Loan approval standards are established and maintained solely by individual Lenders. Consumers should rely on their own judgment in deciding which available loan product, terms, and Third-Party Provider best suit their needs and financial means. Loan Compass: (a) is not a Lender, loan originator, loan processor or underwriter; (b) does not aid or assist borrowers in obtaining loans, solicit borrowers or Lenders for loans, offer or negotiate terms of loans; (c) does not take mortgage applications, make loans or credit decisions or pre-approve borrowers for loans; (d) is not an agent of either any consumer or any Lender; (e) does not endorse, refer or recommend any Third-Party Provider that pays Loan Compass or the products of any Third-Party Provider that pays Loan Compass; (f) is not responsible for any errors or delays caused by consumers or any Third-Party Provider in the loan process; and (g) does not guarantee offer of, or acceptance into, any particular loan program or specific loan terms, conditions, or rates with any Third-Party Provider, or that any rates or terms will be the best available.

3.  Prohibited. You agree not to:

a. Use the Services for any illegal purpose, or in violation of any local, state, national, or international law;
b. Violate or encourage others to violate the rights of third parties, including intellectual property rights;
c. Post, upload, or distribute any content that is unlawful, defamatory, libelous, inaccurate, or that a reasonable person could deem to be objectionable, profane, indecent, pornographic, harassing, threatening, hateful, or otherwise inappropriate;
d. Interfere in any way with security-related features of the Services;
e. Interfere with the operation or any user’s enjoyment of the Services, including by uploading or otherwise disseminating viruses, adware, spyware, worms, or other malicious code, making unsolicited offers or advertisements to other users, or attempting to collect personal information about users or third parties without their consent;
f. Access, monitor or copy any content or information of the Site using any robot, spider, scraper, or other automated means or any manual process for any purpose without Loan Compass’s express written permission;
g. Perform any fraudulent activity, including impersonating any person or entity, claiming false affiliations, accessing the accounts of other users without permission, or falsifying your identity or any information about you, including age or date of birth; or
h. Sell or otherwise transfer the access granted herein.

4.  Intellectual Property and User Content. The Loan Compass Services are protected by applicable copyright and other intellectual property laws, and no materials from the Services may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way without our express permission.  All trademarks and service marks on the Services belong to Loan Compass, except third-party trademarks or service marks, which are the property of their respective owners.  You represent and warrant that you own or otherwise have the right to use any content you post to the Services.  If you believe that your content has been used in a way that constitutes copyright infringement, you may contact at [email protected].  You must provide the following information: an electronic or physical signature of the copyright owner or the person authorized to act on behalf of the copyright owner; a description of the copyrighted work that you claim has been infringed; a description of where the material that you claim is infringing is located; your address, telephone number, and email address; a written statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.  Loan Compass has adopted and implements a policy that provides for termination in appropriate circumstances of accounts of users who repeatedly infringe copyright or other intellectual property rights of Loan Compass or others.

5.  Indemnification. You agree that you will be personally responsible for your use of the Services, and you agree to defend, indemnify, and hold harmless Loan Compass from and against any and all claims, liabilities, damages, losses, and expenses (including attorneys’ and accounting fees and costs), arising out of or in any way connected with (i) your access to, use of, or alleged use of the Services; (ii) your violation of the Terms or any applicable law or regulation; (iii) your violation of any third party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right; or (iv) any disputes or issues between you and any third party.  Loan Compass reserves the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with our defense of such claim.

6. Termination/Changes to Agreement. If you violate any provision of these Terms of Use, your permission from Loan Compass to use the Services will terminate automatically. In addition, Loan Compass may in its sole discretion terminate your account on the Services or suspend or terminate your access to the Services at any time for any reason, with or without notice. After your account is terminated, information and content previously provided by you will no longer be accessible through your account, but Loan Compass may continue to store such information and content, and it may also be stored by third parties to whom it has been transferred through your use of the Services.  Loan Compass may alter, suspend or discontinue the Services or any portion of the Services without notice. Loan Compass will not be liable whatsoever for any change to the Services or any suspension or termination of your access to or use of the Services. Loan Compass reserves the right to change these Terms of Use at any time in its sole discretion on a going-forward basis. We will make commercially reasonable efforts to notify you of any material changes to these Terms of Use. Your continued use of the Services after updates are effective will represent your agreement to the revised version of these Terms of Use. Your continued use of the Services after the effectiveness of such changes will constitute acceptance of and agreement to any such changes. You further waive any right you may have to receive specific notice of such changes to these Terms of Use. You are responsible for regularly reviewing these Terms of Use.

7.  Disclaimers of Warranties. The Services are provided “as is” and on an “as available” basis, without warranty or condition of any kind, either express or implied.  Although Loan Compass seeks to maintain safe, secure, accurate, and well-functioning services, we cannot guarantee the continuous operation of or access to our Services, and there may at times be inadvertent technical or factual errors or inaccuracies.

a. No Warranties. Loan Compass specifically (but without limitation) disclaims (i) any implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment, or non-infringement; and (ii) any warranties arising out of course-of-dealing, usage, or trade.  You assume all risk for any/all damages that may result from your use of or access to the Services.  Loan Compass is not responsible for the loss of, damage to, or unavailability of any information you have made available through the Services, and you are solely responsible for ensuring that you have backup copies of any information you have made available through the Services.
b. No Guarantee Of Accuracy. Loan Compass does not guarantee the accuracy of, and disclaims all liability for, any errors or other inaccuracies in the information, content, recommendations, and materials made available through the Services.
c. Services Provided For Informational Purposes. The information provided through the Services is provided solely for informational, educational, or entertainment purposes and does not constitute legal, financial, tax planning, real estate, or other advice from Loan Compass.  Loan Compass makes no representations, warranties, or guarantees, express or implied, regarding the results or savings that may be obtained through the use of the Services.  You agree that you are responsible for your own financial research and financial decisions.  Before making any financial decisions or implementing any financial strategy, including recommendations of third parties identified through the Services, Loan Compass recommends that you obtain additional information and advice of accountants or other financial advisors who are fully aware of your individual circumstances.
d. No Warranties Regarding Third Parties. Loan Compass makes no representations, warranties, or guarantees, express or implied, regarding any third party service or advice provided by a third party, or any quotes or offers provided through the Services.  Loan Compass does not endorse any particular advisor or other third party.  Loan Compass acts solely as an intermediary between you and third party service providers and expressly disclaims any and all liability for any content, products, or services provided by such service providers.  See Section 3, above, for more information regarding third parties and third party services.

8.  Limitation of Liability. In no event will Loan Compass be liable to you for any incidental, special, consequential, direct, indirect, or punitive damages, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, whether or not Loan Compass has been informed of the possibility of such damage.  Some jurisdictions do not allow the disclaimer of warranties or limitation of liability in certain circumstances.  Accordingly, some of the above limitations may not apply to you.

9.  Governing. These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.  Subject to Section 12, which provides that disputes are to be resolved through binding arbitration or small claims court, to the extent that any lawsuit or court proceeding is permitted hereunder, you and Loan Compass agree to submit to the exclusive personal jurisdiction of the state courts and federal courts located within County of Sussex, Delaware, for the purpose of litigating all such disputes. 

10.  Dispute Resolution by Binding Arbitration. In the interest of resolving disputes between you and Loan Compass in the most expedient and cost effective manner, you and Loan Compass agree to resolve disputes through binding arbitration or small claims court instead of in courts of general jurisdiction (“Agreement to Arbitrate”).  Arbitration is more informal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, allows for more limited discovery than in court, and is subject to very limited review by courts.  Arbitrators can award the same damages and relief that a court can award.  Any arbitration under these Terms will take place on an individual basis; class arbitrations and class actions are not permitted.  You acknowledge and agree that the arbitrator may award relief (including monetary, injunctive, and declaratory relief) only in favor of the individual party seeking relief and only to the extent necessary to provide relief necessitated by that individual party’s claim(s).  Any relief awarded cannot affect other users.

a. Claims To Be Resolved By Binding Arbitration. You and Loan Compass agree to arbitrate all disputes and claims between us.  This agreement to arbitrate is intended to be broadly interpreted.  It includes, but is not limited to: claims arising out of or relating to any aspect of the relationship between us, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory; claims that arose before this or any prior Terms; claims that are currently the subject of purported class action litigation in which you are not a member of a certified class; and claims that may arise after the termination of these Terms.
b. Exceptions. Notwithstanding Section 12(a), you and Loan Compass agree that no statement herein shall be deemed to waive, preclude, or otherwise limit either party’s right to (i) bring an individual action in small claims court; (ii) pursue enforcement actions through applicable federal, state, or local agencies where such actions are available; (iii) seek injunctive relief in any competent court of law; or (iv) to file suit in a court of law to address intellectual property infringement claims.
c. Arbitrator. Any arbitration between you and Loan Compass will be governed by the Commercial Dispute Resolution Procedures and the Supplementary Procedures for Consumer Related Disputes (collectively, “AAA Rules”) of the American Arbitration Association (“AAA”), as modified by these Terms, and will be administered by the AAA.  The AAA Rules and filing forms are available online at www.adr.org, by calling the AAA at 1-800-778-7879, or by contacting Loan Compass.
d. Notice and Process. A party who intends to seek arbitration must first send to the other, by certified mail, a written Notice of Dispute (“Notice”).  The Notice to Loan Compass should be addressed to:  Loan Compass, LLC, 16192 Coastal Highway, Lewes, Delaware, 19958 (“Notice Address”).  The Notice must (a) describe the nature and basis of the claim or dispute; and (b) set forth the specific relief sought (“Demand”). If you and Loan Compass do not reach an agreement to resolve the claim within 30 days after the Notice is received, you or Loan Compass may commence an arbitration proceeding.
e. Fees. Regardless of the manner in which the arbitration is conducted, the arbitrator shall issue a reasoned written decision sufficient to explain the essential findings and conclusions on which the decision and award, if any, are based.  The arbitrator may make rulings and resolve disputes as to the payment and reimbursement of fees or expenses at any time during the proceeding and upon request from either party made within 14 days of the arbitrator’s ruling on the merits.
f. No Class Actions. You and Loan Compass agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.  Unless both you and Loan Compass agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.
g. Opt-Out. If you are a new Loan Compass user, you can choose to reject the arbitration agreement contained in this Section 10 (“opt-out”) by mailing us a written opt-out notice (“Opt-Out Notice”).  The Opt-Out Notice must be postmarked no later than thirty (30) days after the date you accept these Terms for the first time.  You must mail the Opt-Out Notice to the Notice Address listed in Section 10(d), above.
The Opt-Out Notice must contain your name, address (including street address, city, state and zip code), and the user name(s) and email address(es) associated with the Loan Compass account(s) to which the opt-out applies. You must sign the Opt-Out Notice for it to be effective.  This procedure is the only way you can opt out of the Agreement to Arbitrate. If you opt out of the Agreement to Arbitrate, all other parts of the Terms will continue to apply to you. Opting out of this Agreement to Arbitrate has no effect on any previous, other, or future arbitration agreements that you may have with Loan Compass.
h. Modifications. If Loan Compass makes any future change to this Agreement to Arbitrate (other than a change to the Notice Address), you may reject any such change by sending us written notice within 30 days of the change to the Notice Address provided above.  You acknowledge and agree that, in the event you reject any future change, your accountwith Loan Compass shall be immediately terminated and you will arbitrate any dispute between us in accordance with the language of this provision.
i. Severability and Enforceability. If an arbitrator or court decides that any part of this Section 10 is invalid or unenforceable, the other parts of this Section 10 shall still apply. If the entirety of this Section 10 is found to be unenforceable, then the parties agree that the exclusive jurisdiction and venue described in Section 10 shall govern any action arising out of or related to these Terms, and that the remainder of the Terms will continue to apply.

11. Modification of the Services. Loan Compass reserves the right to modify or discontinue, temporarily or permanently, some or all of the Services at any time without any notice or further obligation to you.  You agree that Loan Compass will not be liable to you or to any third party for any modification, suspension, or discontinuance of any of the Services.

12. General.

a. Entire Agreement. These Terms, together with the Privacy Policy constitute the entire and exclusive understanding and agreement between you and Loan Compass regarding your use of and access to the Services, and except as expressly permitted above may only be amended by a written agreement signed by authorized representatives of the parties.
b. No Waiver. The failure to require performance of any provision shall not affect our right to require performance at any time thereafter, nor shall a waiver of any breach or default of the Terms constitute a waiver of any subsequent breach or default or a waiver of the provision itself.
c. Paragraph Headers. Use of paragraph headers in the Terms is for convenience only and shall not have any impact on the interpretation of particular provisions.
d. Severability. In the event that any part of the Terms is held to be invalid or unenforceable, the unenforceable part shall be given effect to the greatest extent possible and the remaining parts will remain in full force and effect.
e. Partner Terms. In some instances, Loan Compass’s third party partners require that Loan Compass users agree to be bound by some additional terms of use that are specific to particular products or services (“Partner Terms”).  In the event of any conflict between the Partner Terms and Loan Compass’s Terms of Use, Loan Compass’s Terms of Use govern and control.

13. Consent to Electronic Communications. By using the Services, you consent to receiving certain electronic communications from Loan Compass as further described in the Privacy Policy. Please read the Privacy Policy to learn more about Loan Compass’s electronic communications practices. You agree that any notices, agreements, disclosures, or other communications that Loan Compass sends to you electronically will satisfy any legal communication requirements, including that those communications be in writing.

14. Notice to California Residents. If you are a California resident, under California Civil Code Section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 N. Market Blvd., Suite S-202, Sacramento, California 95834, or by telephone at (800) 952-5210 in order to resolve a complaint regarding the Service or to receive further information regarding use of the Service.

Privacy Policy

At Loan Compass, we appreciate your use of and contributions to our websites, our mobile and desktop applications (collectively known as the “Services,” or, each individually, a “Service”). Loan Compass respects your privacy and is committed to protecting your personal information.

We encourage you to read this privacy policy to understand the information we collect and how we use and disclose it. This policy applies to all of our Services that link to it.

1. Information Collected by Loan Compass.

When you use the Services, we collect a variety of information from and about you, your devices, and your interaction with the Services. Some of this information identifies you directly or can be used to identify you when combined with other data.

Information you provide. When using the Services, you may be asked to provide personal information about yourself, such as your name, contact information, details about your home or properties you are interested in, and financial information. This may occur, for example, when you register on the Services, correspond with a real estate professional (such as a real estate agent or broker, mortgage lender or loan officer, or others) via the Services, or complete other forms or transactions, such as a request for loan information. You may also provide information about a third party through the Services, for example, if you share a webpage with a recipient via email. We may combine this information with other information we collect from your interaction with the Services or from other companies.
Cookies, web beacons, and other tracking technologies. We and our partners use various technologies to collect information automatically when you access and use the Services, including cookies, web beacons and other similar technologies. Cookies are bits of electronic information that can be transferred to your computer or other electronic device to uniquely identify your browser. When you use the Services, we and our partners may place one or more cookies on your computer or other electronic device or use other technologies that provide similar functionality. We and our partners may use cookies to connect your activity on the Services with other information we store about you in your account profile or your prior interactions on the Services. At any time, you may adjust settings on your browser to refuse cookies according to the instructions related to your browser. However, if you choose to disable cookies, many of the free features of the Services will not operate properly.

The pages on the Services may also include web beacons or pixels, which are electronic files to count users who have visited that page, to track activity over time and across different websites, to determine users’ interactions with emails we send, to identify certain cookies on the computer or other electronic device accessing that page, or to collect other related information, and this information may be associated with your unique browser, device identifier, or Internet Protocol address. We may, for example, implement a pixel on the pages of the Services where you view a certain advertisement so that we can track whether you visit a website associated with that advertisement at a later time.

Third-party cookies, web beacons, and other tracking technologies. We work with service providers and advertising networks to track and manage cookie information and your activities while you’re using the Services and your online activities over time and across different websites and devices. For example, third parties may use cookies to deliver advertisements to you based on your visit to the Services. For additional information, please refer to the section below entitled, “Interest-Based Advertising.” You may opt-out of cookie tracking and analysis from any of these service providers and advertising networks by Opting Out as explained below in Section 5.
Mobile device and mobile browser information. You may adjust settings on your mobile device and mobile browser regarding cookies and sharing of certain information, such as your mobile device model or the language your mobile device uses, by adjusting the privacy and security settings on your mobile device. Please refer to the instructions provided by your mobile service provider or mobile device manufacturer.
Location Data. If you enable location services on your mobile device, Loan Compass may collect the location of your device, which we use to provide you with location-based information and advertising. If you wish to deactivate this feature, you can disable location services on your mobile device.
Usage logs. We may collect information about your use of our Services, including the type of browser you use, access times, pages viewed, your IP address and the page you visited before navigating to our Services. We may also collect information about the computer or mobile device you use to access our Services, such as the hardware model, operating system and version, unique device identifiers, mobile network information, and browsing behavior.
Public content. You may provide information publicly through the Services, such as when you contribute comments or reviews.
Social networks. If you use the social networking connection functions offered through the Services, we may access all of your social network profile information that you have made available to be shared and to use it in accordance with this privacy policy. Please refer to the instructions governing your social network account to manage the information that is shared through your account.

2. How Loan Compass Uses Your Information

Loan Compass generally uses the information collected about you to provide and improve the Services, including to:

provide and deliver the Services and send related information such as confirmations;
send you technical notices, updates, security alerts and support and administrative messages;
respond to your comments, questions and requests and provide customer service;
communicate with you about products, services, offers, promotions, rewards and events offered by Loan Compass and others, and provide news and information we think will be of interest to you;
monitor and analyze trends, usage and activities in connection with our Services;
revise, modify, and update existing Services and develop new Services;
detect, investigate and prevent fraudulent transactions and other illegal activities and protect the rights and property of Loan Compass and others;
personalize the Services and present you with advertising, content or features that we believe will be of interest or useful to you;
facilitate contests, sweepstakes and promotions and process and deliver entries and rewards;
link or combine with information we get from others to help understand your needs and provide you with better service; and
carry out any other purpose described to you at the time the information was collected.

Email Management. You may receive email from Loan Compass for a variety of reasons – for example, if you took an action through the Services or you signed up for a regular report.  Also, you can manage your receipt of some types of communication by following the instructions included in the email we send you. Please note that, even if you unsubscribe from certain email correspondences, we may still need to email you with important transactional or administrative information.

3. When Loan Compass Shares and Discloses Your Information

Your privacy is important and we are committed to protecting your information that identifies you personally. We will only share personal information that you provide outside the public areas of the Services in the following circumstances:

With your consent. When you consent or direct Loan Compass to share the personal information. This happens when you submit your information through many of our Services. For example, if you choose to contact a real estate agent, mortgage lender, or other real estate professional through the Services, your name, phone number, email address, and message content will appear to the recipient of the message.
Service providers to Loan Compass. When Loan Compass hires a service provider to help operate the Services or our business, Loan Compass may give access to personal information only as appropriate to perform the service for Loan Compass, and subject to the terms of this privacy policy.
Partners with whom we conduct business. When Loan Compass partners with other businesses to offer products and services, we may share information with those business partners only as needed to provide those products and services and only subject to the terms of this privacy policy.
Legal obligation or protection from harm.
